Serving a Statutory Demand
A Statutory Demand is an effective form of Debt Recovery when used correctly. Usually before a Winding-up Petition or Bankruptcy Petition can be presented to Court, a Statutory Demand must have been served on the debtor first. This will show the Court the debtor is unable to pay their debts as they fall due.
If you need to organise the service of a Statutory Demand anywhere in England then we can assist you for a fixed fee of £87.50 plus VAT.
- There is no need for County Court action
- The debt should be undisputed and less than 6 years old;
- and for more than £750.00 against a Company £5000 against an individual
- We can serve the Demand straightaway
Demands are relatively straightforward to complete. You then instruct a Process Server to Serve a Statutory Demand for you. You would need to send the completed Demand to us for it to be served correctly on the debtor.
Once served the Statutory Demand gives the debtor a limited amount of time to deal with the debt or potentially they face bankruptcy proceedings. A Statutory Demand is an excellent way of collecting an overdue account.

- Form SD1 - for service against Limited companies
- Form SD2 - SD3 or SD4 - for service against individuals
We serve Statutory Demands throughout England and Wales for a fixed fee. Once served we will provide you with a Certificate of Service to confirm the Statutory Demand has been served on the debtor.
If you would like to instruct us to serve a Statutory Demand then you will either need to email us a completed copy or post two copies of the Demand to us. We may also be able to arrange collection of the Demand from you. Please call us on 0113 286 8380 to discuss.
Our usual fee for serving Statutory Demands is £87.50 plus VAT. An additional charge would apply for collecting the papers. We would attend the service address up to three times if it became necessary.
