How to serve a Statutory Demand
Are you owed money? Do you have outstanding invoices? Are you struggling to get paid?
If so, consider issuing a Statutory Demand against the debtor for recovery of the debt!
More so than ever, it is important to be paid on time. If used correctly, a statutory demand is an effective form of debt recovery but it is important to ensure the demand is served correctly.
How do you deliver "serve" a Statutory Demand
It is very important to ensure a Statutory Demand is delivered "served" correctly in order for you to be able to proceed further and issue a Bankruptcy Petition or Winding-up Petition against the debtor should it be needed.
Statutory Demands are issued and served under the Insolvency Rules 2016. The need to be served either by way of Personal Service "Handed To or Left with" the Debtor, or they can be served by way of Substituted Service in some instances. Substituted service is a way of serving the demand at an address provided certain rules about service are follwoed. Demands are sometimes served by way of advertisement in a newspaper, or a Solicitor can accept service of the demand provided they are instructed and have agreed to do so.
The Stat Demand must be served inline with the current Insolvency Rules or service may be rejected or delayed by the Courts. Completion of the Statutory Demand is usually straightforward but the procedure of serving a Demand can be complicated, particularly where Personal Service cannot be effected, the debtor is evasive and the Substituted Service route needs to be followed. Even minor errors can prevent a Judge from granting the Petition.

- Form SD1 - for service against Limited companies
- Form SD2 - SD3 - SD4 - for service against individuals
There is a simple and cost-effective solution to ensure a Demand is served correctly and this is to employ an experienced Process Server (a person who "serves" legal documents) to serve the Statutory Demand for you. The Process Server will ensure the Demand is served as required and will provide you with a Certificate of Service which you use as evidence to confirm service.
